1. Definitions

In these Terms and Conditions:

• "We," "Us," "Our," refers to Krathong Arc, a financial education provider operating in Bangkok, Thailand
• "You," "Your," "Participant," refers to individuals who inquire about or enroll in our programs
• "Programs" refers to all financial education courses and services offered by Krathong Arc
• "Services" includes program delivery, materials, consultations, and related educational activities
• "Agreement" means these Terms and Conditions together with any program enrollment documentation

2. Acceptance of Terms

By enrolling in any Krathong Arc program, submitting an inquiry through our website, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree to these terms, please do not enroll in our programs or use our services.

3. Eligibility

Our programs are designed for adults aged 18 years or older. By enrolling, you confirm that you meet this age requirement and have the legal capacity to enter into this agreement under Thai law.

4. Program Description and Enrollment

4.1 Program Information: We provide detailed descriptions of each program on our website, including duration, content, format, and pricing. While we strive for accuracy, program details are subject to change. We will notify enrolled participants of any significant changes.

4.2 Enrollment Process: To enroll in a program, you must complete the enrollment process and provide accurate information. Enrollment is subject to availability and our acceptance of your application.

4.3 Program Commencement: Programs commence on the scheduled start date. We reserve the right to postpone or cancel a program if minimum enrollment is not met, in which case you will be offered a full refund or the option to transfer to another program.

4.4 Class Size: To maintain quality, we limit class sizes. Enrollment is on a first-come, first-served basis.

5. Payment Terms

5.1 Program Fees: All program fees are stated in Thai Baht (฿) and are inclusive of VAT as required by Thai law. Fees include program materials and follow-up support as specified in program descriptions.

5.2 Payment Methods: We accept payment via bank transfer, credit card, or other methods specified during enrollment. Payment must be received in full before program commencement unless alternative arrangements have been agreed in writing.

5.3 Late Payment: If payment is not received by the specified deadline, your enrollment may be cancelled and your place offered to another participant.

5.4 Payment Processing: Payment processing is handled by secure third-party payment processors. We do not store complete credit card information.

6. Cancellation and Refund Policy

6.1 Cancellation by Participant:

• Cancellations 14 days or more before program start: Full refund minus ฿500 administrative fee
• Cancellations 7-13 days before program start: 50% refund
• Cancellations less than 7 days before program start: No refund
• No refunds once program has commenced

6.2 Transfer to Another Program: You may transfer your enrollment to another program session of equal or lesser value up to 7 days before program start, subject to availability.

6.3 Cancellation by Krathong Arc: If we cancel a program, you will receive a full refund or may transfer to another program at no additional cost.

6.4 Refund Processing: Refunds will be processed within 14 business days of approved cancellation and returned via the original payment method.

7. Participant Responsibilities

As a program participant, you agree to:

• Attend scheduled sessions punctually and participate actively
• Treat facilitators and fellow participants with respect
• Maintain confidentiality regarding other participants' personal circumstances discussed during programs
• Complete any preparatory materials or assignments as requested
• Provide accurate contact information and notify us of any changes
• Use program materials solely for personal learning purposes
• Not record sessions without prior written permission

8. Intellectual Property

8.1 Program Materials: All program materials, including handbooks, worksheets, presentations, and frameworks, are the intellectual property of Krathong Arc and are protected by Thai copyright law.

8.2 Limited License: Participants are granted a non-exclusive, non-transferable license to use program materials for personal learning purposes only. You may not reproduce, distribute, or commercially exploit these materials without our written permission.

8.3 Participant Feedback: Any feedback, suggestions, or ideas you provide about our programs may be used by us to improve our services without compensation or attribution.

9. Disclaimers

9.1 Educational Nature: Our programs provide financial education and do not constitute professional financial advice, investment recommendations, or legal counsel. Participants are responsible for their own financial decisions.

9.2 No Guarantees: While our programs are designed to build financial understanding and confidence, we make no guarantees about specific outcomes, financial performance, or results from applying program concepts.

9.3 Professional Advice: Participants should consult qualified financial advisors, lawyers, or accountants for advice specific to their circumstances before making significant financial decisions.

9.4 Service Availability: While we strive to provide uninterrupted services, programs may occasionally be affected by circumstances beyond our control. We are not liable for delays or interruptions caused by technical issues, natural disasters, or other force majeure events.

10. Limitation of Liability

To the fullest extent permitted by Thai law:

10.1 Our liability for any claims arising from your participation in our programs is limited to the amount of fees you paid for the specific program.

10.2 We are not liable for indirect, consequential, special, or incidental damages, including loss of income, profits, or data, arising from use of our services.

10.3 Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or other matters where liability cannot be excluded or limited under Thai law.

11. Indemnification

You agree to indemnify and hold harmless Krathong Arc, its facilitators, and employees from any claims, damages, or expenses arising from your violation of these terms or your participation in our programs.

12. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy, which forms part of this agreement. Please review it to understand how we collect, use, and protect your data.

13. Code of Conduct

We maintain a respectful learning environment. Participants who engage in disruptive behavior, harassment, or activities that interfere with program delivery may be removed from the program without refund.

Prohibited conduct includes harassment, discrimination, disruptive behavior during sessions, unauthorized recording, or misuse of program materials.

14. Termination

14.1 By Participant: You may withdraw from a program subject to our cancellation policy outlined in Section 6.

14.2 By Krathong Arc: We reserve the right to terminate your participation if you violate these terms, engage in prohibited conduct, or if continuation of service becomes impractical. In such cases, refunds will be provided at our discretion.

15. Governing Law and Dispute Resolution

15.1 Governing Law: These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any legal proceedings must be conducted in Thailand.

15.2 Jurisdiction: Any disputes arising from these terms or your participation in our programs will be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

15.3 Informal Resolution: Before initiating formal proceedings, we encourage participants to contact us to resolve concerns informally. Most issues can be addressed through direct communication.

16. General Provisions

16.1 Entire Agreement: These Terms and Conditions, together with our Privacy Policy and any program enrollment documentation, constitute the entire agreement between you and Krathong Arc.

16.2 Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver: Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

16.4 Assignment: You may not transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to a successor entity.

16.5 Notices: Notices to you will be sent to the email address you provided during enrollment. Notices to us should be sent to [email protected].

17. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date.

Participants enrolled in programs at the time of changes will be governed by the terms in effect at enrollment. New enrollments will be subject to the current terms.
